Elder Abuse & Nursing Home Negligence

When a loved one is placed in the care of a nursing home or assisted living facility, you expect compassion, dignity, and safety. But when that trust is broken through neglect, abuse, or mistreatment, the results can be devastating.

At Campiche Andrews, we fight for families whose elders have been harmed in care facilities. Whether it’s unexplained injuries, emotional withdrawal, or poor living conditions, we uncover the truth and hold negligent parties accountable.

If you suspect elder abuse, don’t wait. Your loved one’s safety could depend on it.

Personal Injury FAQs
What qualifies as a personal injury case?

A personal injury case arises when someone is harmed—physically, emotionally, or financially—due to another person or entity’s negligence, recklessness, or intentional misconduct. For a case to qualify, there must be:

  • A duty of care owed to you by the at-fault party

  • A breach of that duty (such as unsafe driving, medical error, or property hazard)

  • An injury or loss (e.g., physical harm, lost income, emotional trauma)

  • Proof that the breach caused the harm

Common qualifying situations include car accidents, medical negligence, nursing home abuse, slip-and-fall incidents, defective products, and wrongful death.

You may have a valid personal injury claim if:

  • You were injured, either physically or emotionally

  • The injury was caused by someone else’s negligence or wrongful act

  • The incident led to tangible damages, such as medical bills, lost wages, or reduced quality of life

Even if you’re unsure who was at fault, it’s worth speaking with an attorney. A qualified personal injury lawyer can assess your situation, gather evidence, and help determine if you have a strong legal case. In Washington, you typically have three years from the date of injury to file a claim—so don’t wait too long.

In Washington, personal injury victims can pursue compensation—also known as damages—for both economic and non-economic losses. This may include:

  • Medical expenses (past and future)

  • Lost wages and reduced earning capacity

  • Pain and suffering

  • Emotional distress

  • Loss of enjoyment of life

  • Property damage (e.g., vehicle repair)

In some cases, if the at-fault party acted with extreme negligence or intentional harm, punitive damages may also be awarded. The value of your claim depends on the severity of your injuries, long-term effects, and impact on your life.

In most cases, you have three years from the date of the injury to file a personal injury lawsuit in Washington State. This is known as the statute of limitations. If you miss this deadline, your claim may be permanently barred—no matter how strong your case is.

Important: Some exceptions may apply (e.g., claims against government agencies or involving minors), so it’s best to consult a lawyer early.

Most personal injury lawyers, including our team at Campiche Andrews, work on a contingency fee basis. That means:

  • No upfront costs

  • No hourly billing

  • You only pay if we win

Our fee is a percentage of the final settlement or verdict. If we don’t secure compensation for you, you owe nothing. This ensures you get quality representation without financial risk.

Not necessarily. In fact, most personal injury cases settle out of court through negotiation or mediation. However, if the insurance company refuses to offer a fair settlement, your attorney may recommend filing a lawsuit and going to trial.

We prepare every case as if it will go to court—so you’re fully protected if litigation becomes necessary. You’ll always have a say in how far the case goes.

The timeline depends on the complexity of the case, severity of injuries, and whether the claim settles or goes to trial. On average:

  • Simple claims may resolve in a few months

  • Moderate cases typically take 6–12 months

  • Serious injury or contested cases can take 1–2 years or more

While faster resolutions are possible, it’s crucial not to settle too soon—especially if you’re still receiving medical treatment. A fair outcome takes time to build.
